Jan. 27, 2022—A Harris County, Texas, man is seeking monetary damages against Take 5 Oil Change after he alleged a shop put the wrong oil in his truck, causing significant damage.

In a complaint filed with Harris County District Court, Pedro Martinez says the Take 5 Oil Change on North Shepherd Road in northwest Houston poured the wrong oil into his 2003 Ford Expedition during a March 2021 service appointment. Per the Southeast Texas Record, Martinez claims the Expedition "began to make a knocking noise" that a mechanic attributed to the wrong oil being used.

In the complaint, Martinez claims the vehicle's engine needs to be rebuilt, adding that Take 5 has "failed to compensate him for the unworkmanlike services and that their actions constitute breach of contract and violation of the Texas Deceptive Trade Practices Act."

Martinez is seeking damages between $250,000 and $1 million.
