Woman Sues After Falling into Lower Bay

The plaintiff alleges negligence and liability for a Take 5 shop.

July 19, 2019—A woman is suing Take 5 Oil Change after she fell into the opening to the lower bay at a shop in Pasadena, a suburb of Houston.

The SE Texas Record reports that Zayra Hernandez filed the lawsuit in Harris County District Court on July 2.

Hernandez claims that she was waiting in her vehicle for service at the shop when an employee called her out of the vehicle. While she was walking around, she "fell through an opening meant to allow service technicians to access the undercarriage of vehicles," according to the news report.

The woman says she suffered pain, mental anguish, impairment and medical expenses. She is seeking up to $200,000 in damages.
